An 1848 Land Indenture

This indenture is one of a group of documents transcribed and contributed by researcher Ron Reid! "What I am trying to do is find a solid connection between Friend Kenyon and a supposed son by the name of Jonas Kenyon. There is a lot of circumstantial evidence but I am still searching for that irrefutible link. Therefore I am working from Friend Kenyon forward and Jonas Kenyon backwards. I will probably be getting more into the Garlock/Garlach line because we know Friend Kenyon married a Garlock and came from Herkimer to Wayne with the Garlock bunch in the 1830's."

This indenture made the First day of June one thousand eight hundred and forty eight between Masterton Ure and John Gordon, the heir attorney Joseph Fellows by virtue of a power of attorney bearing date Viz Seventeenth day of August one thousand eight hundred and thirty, of the first part, and Eliza Garlach, Juliet Garlach, Solomon Garlach, Catharine Garlach, Alfred Garlach, and Abraham Garlach children and devisees of Jacob P. Garlach late of Marion in the County of Wayne deceased and Friend Kenyon of the same town a devisee of the said Jacob P. Garlach deceased of the second part witnesseth that the parties of the first part, for and in consideration of the sum of five hundred Dollars to them paid by the party of the second part, the receipt, whereof is hereby acknowledged have and each of them hath sold and by these presents do, and each of them doth, grant, sell, and convey, unto the party of the second part, their heirs and assigns, All that certain piece or parcel of land situate in the town of Marion in the County of Wayne and State of New York know and distinguished as the north east part, of Lot number two in the third range of Lots, in township number thirteen in the second range of township and bounded as follows, beginning at the south east corner of Isreal Springers land thence south one degree thirty minutes west, twenty six chains sixty links to the north east corner of Joseph Caldwells land thence north eighty eight degrees west, thirty four chains sixty eight links along the north line of said Caldwells land to a stake Thence north six degrees thirty minutes east, twenty six chains forty eight links to a stake standing on the south line of Israel Springers land, thence south eighty eight degrees fifteen minutes east thirty two chains thirty three links along the south line of said Springers land to the place of beginning, containing, containing (sic) eighty eight acres and seventy seven hundredths of an acre as surveyed by Abner F. Lakey be the same more or less. Together with the appurtenances to the said premises belonging, and all the estate title and interest, both in law and in equity of them the parties of the first part, and each of them in the same: To have and to hold the said granted premises with the appurtenances, unto the party of the second part, their heirs and assigns forever in severalty according to the devises by the last will and testament of the said Jacob P. Garlach to the said parties of the second part respectively, of the lands and premises hereby conveyed. And the said Masterton Ure and John Gordon by their said Attorney do covenant and agree with the said party of the second part their heirs and assigns, that they the said Masterton Ure and John Gordon have not done suffered or committed any act matter or thing to change charge or incumber the title to the said granted premise or any part thereof. Provided always, that nothing herein contained shall be construed to be a covenant of Warranty of the title to said premises against a sale of the same or any part thereof for taxes which may have been imposed subsequent to the first day of January Eighteen Hundred and eleven. In witness whereof the said Masterton Ure and John Gordon by their said Attorney have hereunto set their hands and seals on the day and in the year first above written

Erie County       I James Mullett one of the Justices of the supreme court of the
said state do hereby certify that on the twenty third day of June 1848, personally
appeared before me Joseph Fellows to me known to be the person of that name described
in and who executed the within deed, and he acknowledged that he executed the same as
the attorney of the within named Masterton Ure and John Gordon        Jas. Mullett
