1852 Kenyon/McOmber Land Indenture

This indenture is one of a group of documents transcribed and contributed by researcher Ron Reid! "What I am trying to do is find a solid connection between Friend Kenyon and a supposed son by the name of Jonas Kenyon. There is a lot of circumstantial evidence but I am still searching for that irrefutible link. Therefore I am working from Friend Kenyon forward and Jonas Kenyon backwards. I will probably be getting more into the Garlock/Garlach line because we know Friend Kenyon married a Garlock and came from Herkimer to Wayne with the Garlock bunch in the 1830's."

This Indenture made this thirtieth day of December in the year of our Lord one thousand eight hundred and fifty two, between Amos McOmber and Lucy his wife of the town of Marion county of Wayne, and state of New York of the first part, and Erastus Kenyon of same county and state of aforesaid of the second part Witnesseth, that the said parties of the first part in consideration of the sum of One hundred and sixty dollars to them duly paid have sold and by these presents do grant and convey to the said party of the second part, his heirs and assigns all that tract or parcel of land situate in the Village of Marion Town aforesaid and Bounded as follows, Towit: Beginning on the northline of the highway running westerly from the public house at Marion Village at a stake one hundred and fifty feet from the southeast corner of the lot formerly owned by Wm Havell now owned by Joseph Caldwell thence northerly at right anges (sic) with said highway to the south line of E.R. Wrights land, thence easterly along said Wrights land and lands belonging to the Congregational Society to the west line of said Society thence southerly to the south west corner of said Society's land, thence southerly to a stake on the north line of the highway aforesaid, fiftyfeet from the place of Beginning thence westerly along the north line of said highway to the place of beginning With the appurtenances and all the estate title and interest therein of the said parties of the first part, and the said Amos McOmber does hereby covenant and agree to and with the said hereditments [preceding word stricken out] party of the second part, his heirs and assigns the said premises thus conveyed in the quiet and peaceable possession of the said party of the second part, his heirs and assigns he will forever warrant and Defend, against any person whomsoever lawfully claiming the same or any part thereof. In witness whereof the parties of the first part, have hereunto set their hands and seals the day and year first above written.

Wayne County ss:   } On this thirtyfirst day of December in the year one thousand eight hundred and fifty two, before me the subscriber personally appeared Amos McOmber and Lucy H. his wife to me known to be the person described in and who executed the within instrument who severally acknowledged that they executed the same. And the said Lucy H. On a private conversation by me apart from her said husband acknowledged that she executed the same fully and without any fear and compulsion of her said husband. Nathan Boshwick
