1905 Bills/Kenyon Land Indenture

This indenture is one of a group of documents transcribed and contributed by researcher Ron Reid! "What I am trying to do is find a solid connection between Friend Kenyon and a supposed son by the name of Jonas Kenyon. There is a lot of circumstantial evidence but I am still searching for that irrefutible link. Therefore I am working from Friend Kenyon forward and Jonas Kenyon backwards. I will probably be getting more into the Garlock/Garlach line because we know Friend Kenyon married a Garlock and came from Herkimer to Wayne with the Garlock bunch in the 1830's."

THIS INDENTURE, Made this Third day of June in the year of our Lord, one thousand nine hundred and five, between Hiram R Bills and Orissa E. Bills his wife, of Big Rapids Michigan, of the first part, and George D. Kenyon, of Chicago, Illinois, of the second part;

Witnesseth, That the said parties of the first part, for and in consideration of the sum of Twenty Five Hundred Dollars, to them in hand paid by the said party of the second part, the receipt whereof is hereby confessed and acknowledged, do by these presents, grant, bargain, sell remise, release, alien and confirm unto the said party of the second part and his heirs and assign, forever, All those certain pieces or parcels of land situate and being in the Town of Macedon, county of Wayne and State of New York, and described as follows, to wit:

FIRST - Part of Lot Number Sixty two (62), bound as follows, beginning at a stake in the center of the highway where it crosses the west line of the aforesaid lot; thence North Four degrees and forty-five minutes East along the lot line seven chains an ninety-eight links to a stake; thence Southerly parallel with the west line two chains and eighty-six links to a stake near the center of the aforesaid highway; thence Northwesterly along the center of aforesaid highway three chains and ninety-six links to place of beginning, containing two and one half acres of land, as surveyed by E.F. Maine, subject, however, always to a right-of-way two rods wide on the west line as guaranteed heretofore by one George Herman and Emma Herman, his wife.

SECOND- Part of Lot Number Sixty-two, described as follows, beginning on the West line of said Lot in the angle of John Fritt's lands and at the northwest corner of lands owned by said George Herman and Emma Herman, his wife; running thence South five and one-half degrees west along the lot line fourteen chains and sixty seven links to a stake; thence south eighty-four and one half degrees east thirty chains and sixty seven links to a stake in the swamp on the sub-division line fourteen chains and sixty-seven links to a stake at the North line of lands of said George Herman and Emma Herman his wife; thence north eighty-four and one-half degrees west thirty chains and sixty seven links to the place of beginning, containing forty-five acres of land as surveyed by E.F. Maine, Excepting and Reserving the right-of-way of the width of two rods leading from the southwest corner of the above described premises to the center of the highway, leading past the dwelling house of said George Herman and Emma Herman, his wife, said right-of-way to be on the west line of the remaining land of said George Herman and Emma Herman, his wife, the same to be for ingress and egress at all times for the said party of the second part and his agents, Together with all and singular, the hereditaments and appurtenances thereunto belonging or in anywise appertaining; To have and to hold the said premises as above described, with the appurtenances, unto the said party of the second part, and to his heirs and assign forever. And the said Hiram R. Bills, party of the first part, for himself, heirs, executors and administrators, does covenant, grant, bargain and agree to and with the said party of the second part, his heirs and assigns, that the time of the ensealing and delivery of these presents, he is well seized of the above granted premises in Fee Simple, that they are free from all incumbrances whatever, except a certain mortgage heretofore given by Josiah Bills to the Village of Palmyra, the principal thereof being Eight hundred dollars and interest as provided for therein, and that he will, and his heirs, executors and administrators shall Warrant and defend the same against all lawful claims whatsoever, except as against said mortgage, Subject to which this instrument is given.

In Witness Whereof, the said parties of the first part have hereunto set their hands and seals the day and year first above written.
