At a Surrogates Court held in the town of Lyons in the County of Wayne, on the Eight day of August 1843, before James C. Smith Surrogate of said county for the purpose of proving and recording the last will and testament of Jacob P. Garlock late of the town of Marion in said county deceased, pursuant to and act concerning the proof of wills &c. passed May 16, 1837, on the application of Richard Garlock and Edgar M. Galloway, two of the Executors named in the said will.

Richard Garlock and Edgar M. Galloway the said applicants and also Jacob Garlock the other Executor named in the said will appeared in person.

Eliza Garlock and Anna Kenyon two of the heirs and next of kin to the said deceased, and Marvin Rich the special guardian appointed for the minor heirs of the said deceased, appeared also in person. The widow and the other heirs and next of kin, did not appear but made default.

Due proof was then exhibited of the service of the citation on the widow heirs and next of kin to the said deceased named therein, which said citation and proof of service are filed in the office of the said Surrogate.

Marvin Rich was then affirmed as a witness on the part of the said applicants, and testified as follows that is to say: I knew Jacob P. Garlock of the town of Marion in the County of Wayne. He died in the month of June last at the said town of Marion, which was the place of his residence at the time of his death. I have before seen the paper now produced in court purporting to be the last will and testament of the said Jacob P. Garlock, and bearing date the thirty first day of January eighteen hundred and forty three. The said Jacob P. Garlock subscribed his name at the end of the said instrument on the day of its date. Such subscription was made by the said Jacob P. Garlock, in my presence and also in the presence of Hiram Rich, whose name is subscribed as a witness to the said instrument. At the time of making such subscription the said Jacob P. Garlock declared the said instrument so subscribed by him to be his last will and testament. I signed my name as a witness at the end of the said instrument at the request of the said Jacob P. Garlock, at the same time that he subscribed the same. The said Hiram Rich also signed his name as a witness at the end of the said instrument at the request of the said Jacob P. Garlock at the same time. At the time of subscribing the said instrument as aforesaid the said Jacob P. Garlock was of full age, of sound mind and memory, and not acting under restraint.
